Terms of Service
These Terms of Service ("Terms") govern your use of 7, 11, Doubles (the "Game"), whether you play it as a Discord Activity or on the web at dice.housetandem.com. The Game is provided by Users First LLC, an Ohio limited liability company, together with HouseTandem ("we," "us," "our"). By using the Game, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Game.
1. Who can play
You must be at least 13 years old, and old enough to use Discord where you live if you play through Discord. If you're under the age of majority where you live, you may use the Game only with the involvement of a parent or guardian who agrees to these Terms.
2. Entertainment only: no gambling
The Game is a free, casual game played for fun. Points have no monetary value, can't be bought, sold or exchanged, and don't entitle anyone to a prize. You may not use the Game to place, settle or track real-money bets or wagers of any kind. Dice results are generated randomly by the Game and aren't intended to predict or reproduce the odds of any gambling product.
3. Using Discord
When you play as a Discord Activity, your use of Discord is also governed by Discord's Terms of Service and Community Guidelines. Discord isn't responsible for the Game, and we aren't responsible for Discord.
4. Your conduct
When using the Game, you agree not to:
- use a display name or avatar that is unlawful, hateful, harassing, sexually explicit, or that impersonates someone else;
- harass, threaten or abuse other players;
- cheat, or tamper with the Game, its network messages or its servers, including by sending forged or modified game data, impersonating other players, or trying to influence dice results;
- disrupt or overload the Game or its servers, or attempt to gain unauthorized access to any system or another player's session;
- use bots, scripts or automation to play, except for testing tables you control;
- use the Game for any unlawful purpose or in violation of any applicable law.
We may restrict or block access to the Game to enforce these rules.
5. The service
We provide the Game free of charge and may change, suspend or discontinue all or part of it at any time without notice. Games are hosted live by players' devices and our servers. Tables may disconnect, and scores and game history aren't saved once a table ends.
6. Intellectual property
The Game, including its software, design, text and graphics, is owned by Users First LLC and its licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Game for its intended purpose under these Terms. Where any of the Game's source code is published under a separate license, that license governs that code. "Discord" is a trademark of Discord Inc. The Game isn't affiliated with or endorsed by Discord.
7. Feedback
If you send us ideas or suggestions, we may use them freely without any obligation to you.
8. Disclaimers
The Game is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that the Game will be uninterrupted, secure or error-free.
Shaking or flicking your phone is part of the Game. Hold your device securely, be aware of your surroundings, and don't play while driving or in any situation where it could be unsafe. You're responsible for your device and for any damage caused by dropping or throwing it.
9. Limitation of liability
To the fullest extent permitted by law, Users First LLC, HouseTandem and their members, officers, employees and agents won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or devices, arising out of or relating to the Game, even if advised of the possibility of such damages. Our total liability for any claim relating to the Game won't exceed fifty U.S. dollars (US$50).
Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
10. Indemnity
You agree to indemnify and hold harmless Users First LLC and HouseTandem from any claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Game or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Game will be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction. Nothing in this section takes away any rights you have under the mandatory consumer protection laws of the place where you live.
12. Changes to these Terms
We may update these Terms from time to time. We'll post the new version here and update the effective date. Continuing to use the Game after a change means you accept the updated Terms.
13. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any provision isn't a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Game. You may not assign these Terms. We may assign them as part of a merger, acquisition or sale of assets.
